Child Justice Bill

The objectives of the Bill for consideration, the Child Justice Bill are:

  • To establish a criminal justice process for children accused of committing offences, that aims at protecting the rights of children as provided for in international instruments;
  • To provide for the minimum age of criminal responsibility of a child;
  • To incorporate diversion of cases away from the formal court procedures;
  • To establish a procedure for the assessment of children and an initial inquiry as compulsory procedures;
  • To extend sentencing options available in respect of children; and
  • To entrench the notion of restorative justice in respect of children
